| abstract | The question of the future of the law is strengthened, given the weakness caused by the globalization of its main translator, the nation-state. For legal theory, there was a pluralization of existing sources of law, particularly by non-state regulation and an intense debate over the width of the legal concept and doubt about its difference from other social norms. This work deals with these processes and addresses the debate about the democratic deficit in international legal norms. It reviews two models of post-national democracy: the issues raised by Immanuel Kant's world state and the Bahá'í concept of a "Global Commonwealth of Nations" in consideration of the consequences for rights at the international level, the chances of a global democracy. and the possibility of global solidarity. Regardless of whether the idea of a global or plural or a mixed form is favored from both legal systems, the legal theory comparison of different sources of law can provide rewarding insights for the law, particularly for a careful construction of an international legal order model. |
